Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and Hamza Enterprises (“Hamza Enterprises”, “we”, “us” or “our”), the operator of the TradeTidingswebsite and service (the “Service”). TradeTidings is a service operated by Hamza Enterprises. By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Service.

1. Important — not financial advice

TradeTidings is an informational and educational publisher of original news-sentiment and stock-impact analysis. Nothing on the Service is, or should be construed as, investment, financial, trading, legal, accounting, or tax advice, a recommendation, solicitation, or an offer to buy, sell, or hold any security or other financial instrument. We are not a broker, dealer, investment adviser, securities adviser, portfolio manager, or fiduciary, and we are not licensed or registered as such with the Securities and Exchange Commission of Pakistan (SECP)or any other regulator. The “sentiment” we display reflects how news may affect a company's exposure; it is not a price prediction, a forecast, or a buy/sell signal. Full details are in our Disclaimer, which forms part of these Terms. You are solely responsible for your own investment decisions and should consult a licensed professional and do your own research before acting.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements and that your use complies with all laws that apply to you.

3. The Service

The Service ingests publicly available business-news headlines, generates original analysis, and maps stories to listed companies with a sentiment direction, an influence level, and a longevity. The analysis is produced substantially through automated and algorithmic means, including machine-learning models, and may contain errors, omissions, or misclassifications. We may add, change, suspend, or remove features at any time without notice.

4. Accounts

Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity under your account. Notify us promptly at admin@tradetidings.com of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree that you will not:

• use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• scrape, crawl, harvest, frame, cache, or systematically extract content, or use automated means to access the Service, except as expressly permitted by us in writing;
• copy, reproduce, redistribute, resell, sublicense, or create derivative works from the Service or its content without our prior written consent;
• circumvent, disable, or interfere with security, access controls, rate limits, or usage limits;
• introduce malware, attempt to gain unauthorised access, or disrupt or overload the Service or its infrastructure;
• misrepresent your affiliation with us, or remove or alter any proprietary notices; or
• use the Service or its outputs to provide regulated financial services to third parties.

6. Intellectual property

The Service and all of its content, analysis, text, design, software, trademarks, and the TradeTidings name and logo are owned by or licensed to Hamza Enterprises and are protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved. News headlines, feeds, and quotations remain the property of their respective publishers; we cite and link to sources and do not claim ownership of third-party material.

7. Third-party content and links

The Service references and links to third-party news sources and websites. We do not control, endorse, or assume responsibility for any third-party content, products, or services, or for the accuracy of source material. Your use of third-party sites is at your own risk and subject to their terms.

8. Subscriptions and payments

Parts of the Service may be offered free of charge and parts may be offered on a paid subscription. Where paid plans are offered, the applicable price, billing cycle, and any renewal and refund terms will be presented to you before purchase and form part of these Terms. Taxes may apply. We may change pricing on a prospective basis with reasonable notice.

9. Disclaimer of warranties

The Service and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Hamza Enterprises disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be accurate, complete, reliable, current, uninterrupted, secure, or error-free, or that any analysis, sentiment, or data will produce any particular result. You use the Service and rely on any content entirely at your own risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Hamza Enterprises, its owners, directors, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or investment or trading losses, arising out of or relating to your use of, or inability to use, the Service or any content, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) PKR 5,000. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest amount permitted by law.

11. No reliance; your responsibility

Any decision you make based on the Service is your sole responsibility. Investing in securities involves substantial risk, including the possible loss of your entire capital. Past performance is not indicative of future results. You agree that Hamza Enterprises is not responsible or liable for any investment, trading, or financial decision you make, or for any loss you incur, in connection with the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Hamza Enterprises and its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or any law or third-party right; or (c) any decision or action you take in reliance on the Service.

13. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted here with a new “Effective date”. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws principles. You and Hamza Enterprises submit to the exclusive jurisdiction of the courts of Lahore, Pakistan for the resolution of any such dispute, subject to any mandatory consumer-protection rights you may have in your place of residence.

16. General

These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. We are not liable for any delay or failure to perform caused by events beyond our reasonable control (force majeure).
